Health, Fitness and Medical Information

I warrant that, to the best of my knowledge, I am in good health, physically fit, sufficiently trained and adequately prepared to participate in an endurance event of this nature. I further warrant that I am not aware of any medical condition, injury or other circumstance that may make my participation materially more hazardous to myself or others. I undertake to complete the compulsory pre-event medical questionnaire fully, honestly and accurately by the prescribed deadline, disclosing all chronic conditions, prescription medication, allergies and prior medical events that may be relevant to my safe participation. I agree to update my personal profile and notify Millennium Marathon of any medical information changes before race day I acknowledge that participation in the Millennium Marathon involves significant physical exertion and inherent risks, including serious injury, illness, permanent disability and death. I voluntarily accept these inherent risks. If I experience any symptoms, injury or circumstances that make continued participation unsafe, I undertake to stop participating and seek medical assistance. I agree to comply with any instruction from authorised race or medical personnel requiring me to slow down, stop, withdraw from the event or receive medical assessment or treatment.

Release, Limitation of Liability and Indemnity

To the fullest extent permitted by law, and with full knowledge and appreciation of the inherent dangers, risks and hazards associated with participation in a long distance running event, I release the Millennium Marathon and its Board Members, employees, officials, agents, contractors, sponsors, service providers, volunteers, medical personnel, property owners, and national, provincial and local authorities involved in the event (“the Protected Parties”) from liability for any injury, illness, death, loss or damage arising from my voluntary participation in the event or its official pre-race and post-race activities.

This release does not exclude or limit any liability that may not lawfully be excluded or limited, including liability arising from gross negligence, wilful misconduct or any rights afforded to me. I indemnify and hold harmless the Protected Parties against any and all third-party claims, actions, proceedings, losses, damages, costs or expenses (including reasonable legal costs on an attorney-and-own-client scale) arising directly or indirectly from my unlawful conduct, wilful misconduct, material breach of the event’s Rules and Regulations, failure to comply with a lawful instruction, or any negligent act or omission on my part, to the extent permitted by law.

This waiver, release and indemnity is binding on me and, where legally applicable, my estate, executors, heirs, administrators and assigns.
